I have talked about this for quite some time and now a lawsuit is looking to become a class action suit. I think this is just for the Lawyers because any Insurance company can inspect a home any time they want as long as they call in advance and set it up. I know the Inspection companies work for Citizens Insurance and they are on the lazy side when it comes to doing the corrct job, but the real issue is with the departmant that keeps changing the Mitigation Inspection forms we all use. These forms are always said to be good for 5 years, but they are changed every 2 years and most recently again on 2/1/2012.The forms are drafted at the Office of Insurance Regulation(OIR) or w/ the Insurance commissioner’s office and the Insurance companies simply start to require the new form that was created. They are within their rights to do so and anyone would do it if they could make more money in business. Citizens cannot become the Insurer of last resort again as Governor Rick Scott wants, if the rates are the lowest in the Industry. Every carrier is now doing their own inspections of one type or another and they are following the laws for our State. The lawsuit should be against the State for totally screwing up the entire Insurance industry because they do not know how to fix it.Oh I forgot, you cannot sue them as they are above the Law, why is that. In a good article by Julie Patel of the Fort Lauderdale Sun Sentinal, the bill that is now in the Senate version is also being slammed by the CAN.They say that a Primary MD is excluded from the bill which puts the onus on the ER Md’s and going to the ER is already crazy and takes hours. This could also shift the cost of care from the Autopolicy to the Health Insurance policy which will benefit the Auto Insurance carriers and their profits.This will be interesting to see the final bill if the Legislators in Tallahassee can actually agree on doing something this session. PIP Fraud is real and is a huge problem, but Tallahassee and the Insurance commissioner have dodged this bullet for many years. Governor Rick Scott wants change and I think we all agree that change is a must, so we shall see. According to Rep (R) Frank Artiles Citzens is speng to much money fighting claims and then paying anyway. There are 2 thoughts on this? Pay all claims w/ no fight and everyone knows they can collect more or fight claims you feel should not get paid. Julie Patel of the Fort lauderdale Sun Sentinal cover’s this issue pretty well with no real answers only more questions. The real solution is to make Citizens Go away and let the private sector insure the homes, but we still have many areas that private companies will not accept.Older homes, homes East of I-95 in S. Citizens is very busy re-inspectiong thousands of homes just to take away discounts they once gave. This is being done because the questions are differant and can cause you to loose discounts. The weird thing is that the Inspections will change in Feb 2012 again and most people could get back some of those discounts, but people will have to pay for that inspection when they are ready to try. In the meantime, the average increase we see here in Fort lauderdale and S. Florida is about $1000 and that does not include the 10% rate hike. Citizens will continue this process as it will spend about 40 million doing the inspections, but they will make about 100 Million every year with the discounts being taken away. What a business, this is what I want when I grow up!!!
