Lawsuits over denial of coverage for business interruptions due to COVID-19 are piling up in New Jersey courts, but some experts expect the plaintiffs will have a difficult time recovering.

The District of New Jersey saw 20 COVID-19 business interruption suits filed or removed from state court in July alone. A similar pattern is taking place across the nation, and a proposal before the Judicial Panel on Multidistrict Litigation to consolidate those suits could create the largest MDL ever.

Insurance carriers typically say that claims for closures related to COVID-19 are not eligible for business interruption coverage because of a lack of damages to the premises. The plight of businesses whose claims for coverage were turned down has been a high-profile issue, with lawmakers in New Jersey and elsewhere weighing various measures that would mandate coverage under some circumstances.

A bill that would require insurance companies to cover business interruption claims related to the COVID-19 emergency declaration was introduced earlier this year in New Jersey’s Legislature, where it stalled. The Assembly gave the bill a second reading on March 16 but it never reached a floor vote because of discussions over amending it. The measure never made it to the Senate floor as part of a group of bills that made up a COVID-19 emergency package.

Florida’s state-run insurer Citizens Property Insurance Corp. will extend its moratorium on cancellations and nonrenewals until the end of 2020 despite saying earlier this month it would resume processing them on Aug. 15.

The decision comes after Florida CFO Jimmy Patronis urged the insurer not to cancel customer policies during hurricane season and the ongoing COVID-19 pandemic.

“Hurricane season is just beginning to heat up and we are in the middle of an unprecedented health and economic crisis. This is not the time to cancel Citizens’ home insurance policies,” Patronis said in a public statement released by his office, the Florida Department of Financial Services, on July 24.

The insurer originally announced in an agent bulletin July 9 that it would resume the processing of cancellations and nonrenewals beginning Aug. 15, 2020, after imposing a moratorium in March to address a significant uptick in the percentage of premiums not paid by the due date.

Citizens reported that figure has since fallen to pre-COVID-19 levels, and now stands at 7.5%.

Patronis noted that what policyholders owe must still be paid, “but cancelling their policies during hurricane season should not be an option.”

Great news for nearly 800 homeowners who have been unable to do much w/ their homes. Only 46 homes have filed claims w/ Citizens for the drywall claims which occured because of the shortage of normal drywall after the hurricanes Wilma and Katrina. Citizens has also tried to cancel a  few clients w/ the issue including someone from Punta Gorda, but they have rescinded the non renewal saying the damages are not that bad to cancel. These people have enough issues because when the Insurer of last resort wont take on a client then who will. It is bad enough that companies are non renewing people for exposure management, but when they are  cancelled for claim reasons it is very hard to find coverage and now that Citizens will raise rates up to 55% later this year, where will people turn to. Our new Governor Scott  and Legislator’s in Tall.  seem more concearned about the Health of the Insurance carriers and not the financial health of the consumer struggling to save their home and Insurance is just going to get too high. Please read the entire article about some families will finally get some restitution for all these issues they have had to deal with. In Florida, this has been such a problem and they cannot live in the home or purchase Home Insuance as no company even Citizens would take them until the problem was totally repaired. The cost of this was so high, that almost no one could afford it, but now at least 300 families will have some hope and this will give hope to other’s and set a precedent.
