The Supreme Court on Tuesday handed a victory to two whistleblower sisters by upholding a jury verdict that found State Farm defrauded the U.S. government when the insurance company assessed damage caused by Hurricane Katrina along the Gulf of Mexico coast in 2005.

The court ruled 8-0 to reject State Farm’s challenge to a 2015 lower court decision upholding the verdict in a 2006 lawsuit brought by sisters Cori and Kerri Rigsby under the False Claims Act, which lets people sue on behalf of the government over allegations it has been defrauded.

Why pay a claim from your base Insurance carrier(LIke State Farm) when you can say it was flood coverage and then have FEMA pay for the claim????  This also limits the consumer payout to 250K which is the max payour for a building or home for a flood policy. State Farm will try to appeal the case, but they will have to reimburse FEMA 250K and then the claim will have to be reviewed to see if the State Farm policy would have or should have paid more. Perhaps the wright your own Flood policy that every company can do and make money of, should be reviewed and not allowed by carriers that do the Home Insurance policies as well? CEO Barry Gilway will now stop trying to push this plan and try to change it by the Legislative session. The problems were that the Insurance companies had to keep the policies for 10 years and the premium cap was to be like Citizens at 10%. With that Knowldge the plan will fail. In the meantime Citizens and Governor Rick Scott  will also keep trying to work on a Keep out plan, but with Captive agents like State Farm they only add to the problem here in  Florida and Fort Lauderdale. Since they cannot write for any other carrier, every policy they write, weather it should or not, is put Into Citizens and then tell the clients  it is the best thing for them. This is the root of the problem and why we have removed 250K in policies this year, but added over 300K  because of State Farm agents and others that have  3 carriers to sell or less. This accounts for 28% of all agents and in S. Florida I am sure it is way more than that. This is what really needs to be resolved first as well as red lining issues that we cannot discuss here. State Farm had requested 14.9% increase  but was only approved at 6.4%. This inquiry by the OIR in Tallahassee  is just that and the rate hikes will come soon by State Farm. Fort Lauderdale and S. Florida will be hit hard and the amounts should be double what you read. Look at the average increases and then double them if you live in Fort Lauderdale or South Florida and even the rest of Florida will get hit!! These increases come on top of already huge increses this year from each of those carriers, but my info says that 19 carriers are scheduled for rate hikes later this year. Julie Patel of the Fort Lauderdale Sun Sentinal writes this article, but the real unknown question is what will the Citizens rate hikes be for January 2013?? The Mitigation inspections being redone are causing huge rate increases, but if we do not see a large increase from Citizens  people will be choosing Citizens still and that does not meet what the Governor wants to accomplish. Either way, it is very expensive to own a home here in S. Florida as my Insurance is already 50% more than my taxes? 6 rate increases in 2.5 years and the average cost to Florida consumer’s is already averging 150% since then, but this rate hike which will  average 14.2% will cost most in Fort Lauderdale and all of S. Florida about 30% as we are always hit very hard. State Farm is my best friend at L & S as we are saving the clients thousands w/ other carriers, but the Insured’s w/ State Farm are paying through the roof and there is no end in sight. Even though State Farm will now offer the multi policy discount, most will pay so much more that there is no reason to stay w/ the carrier as the rates will be so high. They used to be the largest carrier in Florida, but they are now 3rd to Citizens and Universal P & C. Althogh this should have occured this year, the Citizens board will be likely to approve this new directive from Governor Rick Scott to raise the cap to 25% for 1/1/2013. This could raise another 100 Million per year in revenue to Citizens and help reduce the billions in debt it will have at the next Hurricane.Senator Faano has been a Consumer advocate in this matter and although I do not agree w/ him on many things, he is correct that the entire system is in shambles and needs a total overhaul. In my opinion, we need to begin w/ every carrier that writes car Insurance here in Florida and chooses to not write Home Insurance like State Farm, AllState, Geico, Progressive, Mercury, Traveler’s, Nationwide. In a good article by Julie Patel  of the Sun Sentinal she explains the 2  sides of the story. State Farm sold the state Legislators a bill of goods that this would help the 125K people they dropped 2 years ago froma  double whammy with a rate hike as well on the auto. By allowing the 5% auto discount when a client chooses Citizens they only get the home Increase. Well, this has been very good for State Farm agents who push the clients into Citizens which has now hit 1.5 million policy holder’s and the State Farm agents for both policies. All other agents like us here at L & S Insurance can’t offer this so we are at a distinct disadvantage. This is not good for Citizens or the state as the company is still growing by 1000 policies/ day now and this is against what the State of Florida wants. The Citizens board will now review this law and see if it can be overturned. Now perhaps more people will shop for Home Insurance rates and Car Insurance as well. This is good for the consumer’s to go shoppping and find a better company to be with. This will really be an interesting event for Fort lauderdale State Farm clients as the rates are going up anyway and when this hits the State Farm agents will have to deal with this issue like all of the Independent agents have to deal with as well. Sentor Mike Fasano brought 3 busloads of  people to show a sense of unity that the rate hike for sinkhole needs to be phased in over time instead of the 429% state wide averaged proposed.!!  The  Citizens board refers Senator Fasano  to the now passed and signed SB408 which Senator Fasano voted for because it was from his political party.Now the Senator does not like the repurcussions to the constituents from his territory which happens to be tampa and the biggest sinkhole issues in Florida.Fort lauderdale and S. Florida will not be affected as much for Sink Hole issues, but the rate hikes will be more severe here for other reasons. Rates need to be actuarily sound so they voted ,but  now he is singing the blues! I guess he simply does not understand Insurance and his Governor Rick Scott  seems to think this situation is ok. The outrage from all when the January bills are  received in Mid to late November will be heard even more than now and then what???  Where are all the  carriers our Governor talked about. I see State Farm prices going up 200-300% in some cases where clients call us to shop for them.
