The Supreme Court on Tuesday handed a victory to two whistleblower sisters by upholding a jury verdict that found State Farm defrauded the U.S. government when the insurance company assessed damage caused by Hurricane Katrina along the Gulf of Mexico coast in 2005.

The court ruled 8-0 to reject State Farm’s challenge to a 2015 lower court decision upholding the verdict in a 2006 lawsuit brought by sisters Cori and Kerri Rigsby under the False Claims Act, which lets people sue on behalf of the government over allegations it has been defrauded.

This will also mean much higher premiums for Fort Lauderdale, S. Florida and the entire state for many years to come so a few can get paid. Please enjoy the full article below;

As Florida seeks to revive its private home insurance market after almost a decade without a hurricane, homeowners are pouring $6 billion a year in premiums into a new generation of small, in-state insurance companies with an unproven record of withstanding a major hurricane.

A consumer-oriented rating agency, Weiss Ratings, recently awarded the companies a median grade of C-minus, and even without a major storm to drive up claims, 11 of them have already failed in Florida since 2006, according to state records.

“This is an accident waiting to happen,” said Gavin Magor, senior financial analyst with Weiss, a national agency with a reputation for tough ratings based in Jupiter, Florida.

Responding to the Weiss ratings, Robert Hartwig, president of the Insurance Information Institute, a trade association, said all the companies meet state regulations, noting that other rating agencies gave higher grades.

“Things are moving in the right direction for Florida in attracting private capital. The risk has been diversified and there’s clearly an appetite for this new risk,” said Hartwig.

Almost 80 per cent of Florida’s insured residential and commercial property, valued at about $3 trillion, lies in coastal areas vulnerable to both wind damage and flooding, according to risk modeling experts.

State officials have encouraged the growth of the private market in recent years, seeking to downsize the overloaded state-run Citizens Property Insurance Co., which ballooned as it took on policies after the major companies withdrew.

The major insurers have stayed away from Florida, saying state regulators require rates that are too low to make the risk of doing business profitable.

Citizens remains the single largest carrier in the state, with 14.5 percent market share.

I think we all know that what we have here in Florida is not what we want, but it is all we have. Citizens is not a great place to be and the Private market provides better policies and coverage so we need these new smaller carriers. We need them because the big carriers like State Farm, All State, GEICO, Progressive, Traveler’s, Liberty Mutual, Nationwide and even USAA have all stopped writing new business here in Florida. I think the real question is why is this being allowed when they write business in other states? They should be told to write all lines of business at some price or leave the state!!! No one is willing to tell them this and stand up to them so this is what we have left to deal with. Lawmakers in Tallahassee do not want to do things that make waves because this will not get them re-elected!!!

Why pay a claim from your base Insurance carrier(LIke State Farm) when you can say it was flood coverage and then have FEMA pay for the claim????  This also limits the consumer payout to 250K which is the max payour for a building or home for a flood policy. State Farm will try to appeal the case, but they will have to reimburse FEMA 250K and then the claim will have to be reviewed to see if the State Farm policy would have or should have paid more. Perhaps the wright your own Flood policy that every company can do and make money of, should be reviewed and not allowed by carriers that do the Home Insurance policies as well? In any event please read or follow the story as it is appealed by State Farm and see how even this type of Fraud affects our insurance rates and here in Fort lauderdale and all of South Florida, we are paying for it way to hard these days!! CEO Barry Gilway will now stop trying to push this plan and try to change it by the Legislative session. The problems were that the Insurance companies had to keep the policies for 10 years and the premium cap was to be like Citizens at 10%. With that Knowldge the plan will fail. In the meantime Citizens and Governor Rick Scott  will also keep trying to work on a Keep out plan, but with Captive agents like State Farm they only add to the problem here in  Florida and Fort Lauderdale. Since they cannot write for any other carrier, every policy they write, weather it should or not, is put Into Citizens and then tell the clients  it is the best thing for them. This is the root of the problem and why we have removed 250K in policies this year, but added over 300K  because of State Farm agents and others that have  3 carriers to sell or less. This accounts for 28% of all agents and in S. Florida I am sure it is way more than that. This is what really needs to be resolved first as well as red lining issues that we cannot discuss here. 46% of all Floridians say that Insurance is a huge burden compared to 24% for the tax problem. 4 years ago it was 36% and 31%. Obviously this is a continuing problem that still must be dealt with in Tallahassee. The average premium for a single family  Home Insurance policy in S. Florida is now over 3K/year  and could be close to 4K.Many homes are over 6K especially if they are older homes with Flat roofs even if they are newer. Condo Insurance  policies are never below $1200 these days. How much can the people of Florida handle and how badly will this hurt the desperately needed Real estate recovery that has started?? Home Insurance rate hikes for next year are already approved for many Carriers like Castle Key, Citizens, State Farm and many other’s. More questions than answers today, but please call L & S Insurance at 1-888-244-7400 for all of your quote for Home,Auto, Flood, Business & Commercial and Life Insurance policies as well. State Farm had requested 14.9% increase  but was only approved at 6.4%. That  is not bad for the consumer except the damage was done by State Farm over the last 2 years with 4 additional increases and discounts being removed!  The Increase will begin 2/1/2012 so now we will see more Increases being approved  for other carriers  as well by the (OIR) Office of Insurance Regulation.Citizens Insurance will be at about 10%.Also, always remember that whatever the increase is, the rates in Fort lauderdale and All  of South Florida will always be about double that amount and other parts of North Florida will be the same or possibly lower.  Please read the full article below and call  L & S Insurance at 1-888-244-7400 for all of your quotes for home, Auto, Flood, Business & Commercial and Life Insurance quotes as well.

This inquiry by the OIR in Tallahassee  is just that and the rate hikes will come soon by State Farm. Fort Lauderdale and S. Florida will be hit hard and the amounts should be double what you read. State Farm is my new best friend so many of the loyal cusotmer’s for so many years at these rates are not willing to be clients anymore. Look at the average increases and then double them if you live in Fort Lauderdale or South Florida and even the rest of Florida will get hit!! These increases come on top of already huge increses this year from each of those carriers, but my info says that 19 carriers are scheduled for rate hikes later this year. Julie Patel of the Fort Lauderdale Sun Sentinal writes this article, but the real unknown question is what will the Citizens rate hikes be for January 2013?? The Mitigation inspections being redone are causing huge rate increases, but if we do not see a large increase from Citizens  people will be choosing Citizens still and that does not meet what the Governor wants to accomplish. Either way, it is very expensive to own a home here in S. Florida as my Insurance is already 50% more than my taxes? There are state regulated time frames for processing claims, but Hurricane Wilma claims have been allowed to be much longer than normal. The norm is within 60 days, But Wilma claims have been around for years. In this article by Julie Patel of the Fort lauderdale Sun Sentinal you will see that this claim submitted years after Wilma will now be declined because of the dates it was submitted. I am in agreement w/ the decision as you can always blame the Hurricane for old issues, but you should take care of your home and have it checked to be sure there are no problems. Florida is like Fraudula  and a  lot of Public adjustors just want to blame all unexplained claims to Hurricane Wilma still 4-6 years  later and this cannot still be allowed. 6 rate increases in 2.5 years and the average cost to Florida consumer’s is already averging 150% since then, but this rate hike which will  average 14.2% will cost most in Fort Lauderdale and all of S. Florida about 30% as we are always hit very hard. State Farm is my best friend at L & S as we are saving the clients thousands w/ other carriers, but the Insured’s w/ State Farm are paying through the roof and there is no end in sight. Even though State Farm will now offer the multi policy discount, most will pay so much more that there is no reason to stay w/ the carrier as the rates will be so high. They used to be the largest carrier in Florida, but they are now 3rd to Citizens and Universal P & C.
